Novela ob\u010dansk\u00e9ho z\u00e1kon\u00edku, kter\u00e1 zakotvuje nep\u0159ijatelnost t\u011blesn\u00e9ho trest\u00e1n\u00ed, sice nep\u0159in\u00e1\u0161\u00ed \u017e\u00e1dn\u00e9 sankce, ale vys\u00edl\u00e1 jasn\u00fd sign\u00e1l: n\u00e1sil\u00ed do v\u00fdchovy nepat\u0159\u00ed. I&nbsp;\u201ejedna v\u00fdchovn\u00e1\u201c toti\u017e m\u016f\u017ee zanechat hlub\u0161\u00ed stopu, ne\u017e si mnoz\u00ed p\u0159ipou\u0161t\u011bj\u00ed. Jak t\u011blesn\u00e9 tresty ovliv\u0148uj\u00ed d\u011btskou psychiku? Pro\u010d se p\u0159en\u00e1\u0161ej\u00ed z&nbsp;generace na generaci a&nbsp;pro\u010d je tak t\u011b\u017ek\u00e9 se od nich oprostit? A&nbsp;kde hledat podporu na cest\u011b k&nbsp;laskav\u011bj\u0161\u00edmu rodi\u010dovstv\u00ed?<br \/>\r\n\u00a0<br \/>\r\n[\/perex]<\/p>\r\n<p><em>Zm\u011bna zaji\u0161\u0165uj\u00edc\u00ed ochranu d\u011bt\u00ed p\u0159ed t\u011blesn\u00fdmi tresty by se m\u011bla projevit v\u00a0\u00a7 858 ob\u010dansk\u00e9ho z\u00e1kon\u00edku, kter\u00fd upravuje rodi\u010dovskou odpov\u011bdnost, a\u00a0rovn\u011b\u017e v\u00a0jeho \u00a7 884 odst. 2,<\/em><br \/>\r\n<em>kter\u00fd pojedn\u00e1v\u00e1 o\u00a0p\u0159im\u011b\u0159enosti pou\u017eit\u00ed v\u00fdchovn\u00fdch prost\u0159edk\u016f. Podle nov\u00e9ho zn\u011bn\u00ed \u00a7 858 ob\u010dansk\u00e9ho z\u00e1kon\u00edku budou m\u00edt rodi\u010de povinnost pe\u010dovat o\u00a0d\u00edt\u011b, jeho zdrav\u00ed a\u00a0t\u011blesn\u00fd, citov\u00fd, rozumov\u00fd a\u00a0mravn\u00ed v\u00fdvoj\u00a0<strong>bez t\u011blesn\u00e9ho trest\u00e1n\u00ed, du\u0161evn\u00edho str\u00e1d\u00e1n\u00ed a\u00a0jin\u00fdch poni\u017euj\u00edc\u00edch opat\u0159en\u00ed.<\/strong><\/em><\/p>\r\n<p><em>Zn\u011bn\u00ed \u00a7 884 odst. 2 ob\u010dansk\u00e9ho z\u00e1kon\u00edku m\u00e1 b\u00fdt dopln\u011bno o\u00a0nevyvratitelnou pr\u00e1vn\u00ed domn\u011bnku: \u201eV\u00fdchovn\u00e9 prost\u0159edky lze pou\u017e\u00edt pouze v\u00a0podob\u011b a\u00a0m\u00ed\u0159e, kter\u00e1 je p\u0159im\u011b\u0159en\u00e1 okolnostem, neohro\u017euje zdrav\u00ed d\u00edt\u011bte ani jeho rozvoj a\u00a0nedot\u00fdk\u00e1 se lidsk\u00e9 d\u016fstojnosti d\u00edt\u011bte.\u00a0<strong>Plat\u00ed, \u017ee lidsk\u00e9 d\u016fstojnosti d\u00edt\u011bte se dot\u00fdk\u00e1 t\u011blesn\u00e9 trest\u00e1n\u00ed, p\u016fsoben\u00ed du\u0161evn\u00edho str\u00e1d\u00e1n\u00ed nebo jin\u00e9 poni\u017euj\u00edc\u00ed opat\u0159en\u00ed.<br \/>\r\n<br \/>\r\n<\/strong><\/em><\/p>\r\n<p><img loading=\"lazy\" src=\"https:\/\/www.praha7.cz\/wp-content\/uploads\/2025\/09\/Trin_Hobulet_9-25-4-298x400.png\" alt=\"\" width=\"298\" height=\"400\" class=\"alignnone size-medium wp-image-86353\" srcset=\"https:\/\/www.praha7.cz\/wp-content\/uploads\/2025\/09\/Trin_Hobulet_9-25-4-298x400.png 298w, https:\/\/www.praha7.cz\/wp-content\/uploads\/2025\/09\/Trin_Hobulet_9-25-4.png 590w\" sizes=\"(max-width: 298px) 100vw, 298px\" \/><\/p>\r\n<p><strong><br \/>\r\nPro n\u011bkoho jen p\u00e1r slov, pro jin\u00e9 d\u016fle\u017eit\u00fd sign\u00e1l<br \/>\r\n<\/strong>P\u0159ijet\u00ed novely je prvn\u00edm, ale z\u00e1sadn\u00edm krokem k&nbsp;d\u011btstv\u00ed bez n\u00e1sil\u00ed. \u010cesk\u00e1 republika toti\u017e a\u017e dosud pat\u0159ila spolu se Slovenskem mezi posledn\u00ed zem\u011b Evropsk\u00e9 unie, kde v&nbsp;z\u00e1konech chyb\u011bla jasn\u00e1 deklarace nep\u0159ijatelnosti t\u011blesn\u00fdch trest\u016f a&nbsp;jak\u00e9hokoliv poni\u017euj\u00edc\u00edho zach\u00e1zen\u00ed s&nbsp;d\u011btmi. V&nbsp;kontextu toho, \u017ee n\u00e1sil\u00ed je zak\u00e1z\u00e1no ve \u0161kol\u00e1ch, na pracovi\u0161t\u00edch i&nbsp;v&nbsp;partnersk\u00fdch vztaz\u00edch, je t\u011b\u017eko pochopiteln\u00e9, \u017ee pr\u00e1v\u011b d\u011bti v&nbsp;rodin\u00e1ch byly z&nbsp;t\u00e9to ochrany dosud vy\u0148aty. \u201eV z\u00e1kon\u011b nen\u00ed z\u00e1kaz, ale tato nulov\u00e1 tolerance k&nbsp;n\u00e1sil\u00ed na d\u011btech je d\u016fle\u017eitou podm\u00ednkou pro to, aby bylo mo\u017en\u00e9 p\u0159\u00edpady n\u00e1sil\u00ed skute\u010dn\u011b efektivn\u011b \u0159e\u0161it. Nikdo se tak ji\u017e nem\u016f\u017ee pt\u00e1t, jak moc m\u016f\u017ee rodi\u010d svoje d\u00edt\u011b b\u00edt, aby to bylo v&nbsp;po\u0159\u00e1dku. A&nbsp;\u017ee i&nbsp;tzv. oby\u010dejn\u00e1 \u010desk\u00e1 facka \u010di pohlavek, lepanec, pl\u00e1cnut\u00ed je t\u011blesn\u00fd trest, o&nbsp;tom ji\u017e snad nen\u00ed pochyb,\u201c \u0159\u00edk\u00e1 Petra W\u00fcnschov\u00e1, \u0159editelka neziskov\u00e9 organizace Centrum LOCIKA, a&nbsp;dod\u00e1v\u00e1, \u017ee \u201ez\u00e1kon m\u00e1 v&nbsp;tomto p\u0159\u00edpad\u011b symbolick\u00fd i&nbsp;praktick\u00fd v\u00fdznam: d\u011btmi je vn\u00edm\u00e1n jako d\u016fle\u017eit\u00fd sign\u00e1l, \u017ee spole\u010dnost stoj\u00ed na jejich stran\u011b a&nbsp;\u017ee maj\u00ed pr\u00e1vo na d\u011btstv\u00ed bez bolesti, strachu a&nbsp;poni\u017eov\u00e1n\u00ed a&nbsp;n\u00e1sil\u00ed v\u016f\u010di nim nen\u00ed jejich chyba. Stejn\u011b tak pom\u00e1h\u00e1 jasn\u011b se vymezit v\u016f\u010di n\u00e1sil\u00ed i&nbsp;odborn\u00edk\u016fm a&nbsp;\u0161kol\u00e1m, kte\u0159\u00ed se doposud op\u00edrali p\u0159ev\u00e1\u017en\u011b jen o&nbsp;osobn\u00ed postoje a&nbsp;vlastn\u00ed zku\u0161enosti z&nbsp;rodiny.\u201c<\/p>\r\n<p><strong>Spr\u00e1vn\u00e9 vs. \u0161patn\u00e9<\/strong><br \/>\r\nPr\u00e1v\u011b vlastn\u00ed zku\u0161enost z&nbsp;rodiny hraje velmi d\u016fle\u017eitou roli. To, co jsme jako d\u011bti za\u017e\u00edvali, v&nbsp;n\u00e1s zanech\u00e1v\u00e1 hlubokou stopu \u2013 \u010dasto se nau\u010den\u00e9 vzorce chov\u00e1n\u00ed p\u0159en\u00e1\u0161ej\u00ed d\u00e1l, i&nbsp;kdy\u017e si to sami nep\u0159ejeme. V\u00fdchova, kter\u00e9 se n\u00e1m dostalo, se n\u00e1m m\u016f\u017ee jevit jako \u201enorm\u00e1ln\u00ed\u201c, pr\u00e1v\u011b proto, \u017ee jsme ji za\u017eili jako jedinou mo\u017enou. A&nbsp;to plat\u00ed i&nbsp;pro t\u011blesn\u00e9 tresty. \u201eV p\u0159edchoz\u00edch generac\u00edch byly fyzick\u00e9 tresty sou\u010d\u00e1st\u00ed v\u00fdchovy. Nejen u&nbsp;rodi\u010d\u016f, ale nap\u0159\u00edklad pr\u00e1v\u011b i&nbsp;ve \u0161kol\u00e1ch. Fyzick\u00fd trest byl \u010dasto pova\u017eov\u00e1n za ,vhodnou a&nbsp;spr\u00e1vnou\u2018 v\u00fdchovnou metodu. Ona zm\u011bna v&nbsp;my\u0161len\u00ed a&nbsp;p\u0159echod z&nbsp;p\u0159edstavy, \u017ee je n\u011bco spr\u00e1vn\u00e9, na p\u0159edstavu, \u017ee je n\u011bco \u0161patn\u00e9, trvala del\u0161\u00ed dobu. P\u0159esv\u011bd\u010den\u00ed typu ,kdy\u017e d\u00edt\u011b zlob\u00ed, pot\u0159ebuje dostat po\u0159\u00e1dn\u011b na zadek\u2018 ale bohu\u017eel st\u00e1le je\u0161t\u011b p\u0159etrv\u00e1v\u00e1,\u201c \u0159\u00edkaj\u00ed shodn\u011b psychologov\u00e9 Anna Stodolov\u00e1 a&nbsp;V\u00e1clav Chytr\u00fd, kte\u0159\u00ed pracuj\u00ed jak s&nbsp;dosp\u011bl\u00fdmi v&nbsp;r\u00e1mci psychoterapeutick\u00e9ho programu Stop n\u00e1sil\u00ed Diakonie \u010ceskobratrsk\u00e9 c\u00edrkve evangelick\u00e9, tak tak\u00e9 ve sv\u00fdch soukrom\u00fdch prax\u00edch, kde se v\u011bnuj\u00ed rodin\u00e1m a&nbsp;d\u011btem.<\/p>\r\n<p><strong>Ochrana vlastn\u00ed minulosti<br \/>\r\n<\/strong>Jak\u00e1koliv ve\u0159ejn\u00e1 debata o\u00a0t\u011blesn\u00e9m trest\u00e1n\u00ed d\u011bt\u00ed (zejm\u00e9na na soci\u00e1ln\u00edch s\u00edt\u00edch) je t\u00e9m\u011b\u0159 v\u017edy bou\u0159livou v\u00fdm\u011bnou n\u00e1zor\u016f. Jedna strana \u0159\u00edk\u00e1, \u017ee \u201ejedna v\u00fdchovn\u00e1\u201c je\u0161t\u011b nikomu neubl\u00ed\u017eila a\u00a0\u017ee do \u201ev\u00fdchovy jejich d\u00edt\u011bte\u201c nem\u00e1 co kdo mluvit. Druh\u00e1 strana jak\u00fdkoliv fyzick\u00fd trest pova\u017euje za nep\u0159ijateln\u00fd, c\u00edt\u00ed v\u00a0n\u011bm lidsk\u00e9 a\u00a0v\u00fdchovn\u00e9 selh\u00e1n\u00ed a\u00a0sv\u016fj n\u00e1zor se sna\u017e\u00ed dok\u00e1zat na v\u00fdsledc\u00edch studi\u00ed, \u017ee fyzick\u00e9 tresty maj\u00ed jednozna\u010dn\u011b negativn\u00ed dopady na psychiku\u00a0d\u011bt\u00ed\u00a0\u2013 budou trp\u011bt \u00fazkostmi, depresemi a\u00a0sami budou m\u00edt probl\u00e9my se zvl\u00e1d\u00e1n\u00edm agresivity.<\/p>\r\n<p><strong>Cesta respektu<br \/>\r\n<\/strong>Pro\u010d m\u00e1 tedy \u010d\u00e1st spole\u010dnosti st\u00e1le dojem, \u017ee \u201epohlavek\u201c neu\u0161kod\u00ed? \u201eProto\u017ee tato v\u011bta je \u010dasto obrann\u00fdm mechanismem a&nbsp;zp\u016fsobem, jak si chr\u00e1nit vlastn\u00ed minulost. P\u0159iznat, \u017ee ,jedna v\u00fdchovn\u00e1\u2018 m\u016f\u017ee bolet nebo zanechat stopu, znamen\u00e1 z\u00e1rove\u0148 p\u0159ipustit, \u017ee i&nbsp;mn\u011b ubl\u00ed\u017eil n\u011bkdo, kdo mne m\u011bl prim\u00e1rn\u011b chr\u00e1nit a&nbsp;milovat. A&nbsp;to nen\u00ed snadn\u00e9. Nav\u00edc n\u00e1s \u010dasto ovliv\u0148uje zkreslen\u00e1 pam\u011b\u0165 \u2013 nevybavujeme si hned samotn\u00fd trest ani to, jak jsme se p\u0159i n\u011bm opravdu c\u00edtili, ale sp\u00ed\u0161e narativ, kter\u00fd kolem n\u011bj vznik\u00e1, to, jak byl rodi\u010di a&nbsp;okol\u00edm interpretov\u00e1n. Mnoz\u00ed z&nbsp;n\u00e1s si ani neuv\u011bdomuj\u00ed, jak moc ovlivnil na\u0161e vztahy, sebev\u011bdom\u00ed nebo zp\u016fsob, jak jedn\u00e1me s&nbsp;druh\u00fdmi,\u201c vysv\u011btluje Petra W\u00fcnschov\u00e1.<\/p>\r\n<p>Tyto vnit\u0159n\u00ed obrann\u00e9 postoje pak \u010dasto komplikuj\u00ed otev\u0159en\u00fd dialog nejen ve ve\u0159ejn\u00e9m prostoru, ale i&nbsp;mezi nejbli\u017e\u0161\u00edmi \u2013 v&nbsp;rodin\u00e1ch, v&nbsp;nich\u017e v\u0161ak m\u016f\u017ee doj\u00edt k&nbsp;ur\u010dit\u00e9mu porozum\u011bn\u00ed, kter\u00e9 v&nbsp;diskuz\u00edch na s\u00edt\u00edch \u010dasto zcela chyb\u00ed. \u201ePom\u00e1h\u00e1 j\u00edt cestou respektu, nikoliv konfrontace. M\u016f\u017eeme t\u0159eba \u0159\u00edct: ,Rozum\u00edm, \u017ee to tak m\u016f\u017ee\u0161 c\u00edtit. Ale dnes u\u017e v\u00edme, \u017ee i&nbsp;drobn\u00e9 t\u011blesn\u00e9 tresty mohly d\u00edt\u011bti ubl\u00ed\u017eit, i&nbsp;kdy\u017e si to t\u0159eba tehdy neuv\u011bdomovalo.\u2018 J\u00e1 se sna\u017e\u00edm vychov\u00e1vat s&nbsp;respektem a&nbsp;beze strachu \u2013 chci, aby na\u0161e d\u00edt\u011b v\u011bd\u011blo, \u017ee mu naslouch\u00e1me a&nbsp;\u017ee se s&nbsp;n\u00e1mi m\u016f\u017ee c\u00edtit v&nbsp;bezpe\u010d\u00ed.\u201c Pom\u00e1h\u00e1 mluvit o&nbsp;tom, \u017ee n\u00e1sil\u00ed nen\u00ed jedin\u00fd zp\u016fsob, jak nastavit hranice, a&nbsp;\u017ee d\u00edt\u011b se u\u010d\u00ed p\u0159edev\u0161\u00edm z&nbsp;p\u0159\u00edkladu dosp\u011bl\u00fdch. M\u016f\u017eeme tak\u00e9 prarodi\u010de pozvat ke spolupr\u00e1ci: \u201eBudu moc r\u00e1da, kdy\u017e n\u00e1s v&nbsp;tom podpo\u0159\u00ed\u0161 \u2013 tvoje role je pro d\u00edt\u011b d\u016fle\u017eit\u00e1,\u201c dod\u00e1v\u00e1 Petra W\u00fcnschov\u00e1.<\/p>\r\n<p><strong>Opakov\u00e1n\u00ed vzorce<\/strong><br \/>\r\nZ&nbsp;rozs\u00e1hl\u00e9 studie odborn\u00edk\u016f z&nbsp;Psychiatrick\u00e9 kliniky 1.&nbsp;l\u00e9ka\u0159sk\u00e9 fakulty Univerzity Karlovy a&nbsp;V\u0161eobecn\u00e9 fakultn\u00ed nemocnice v&nbsp;Praze z&nbsp;roku 2023 vyplynulo, \u017ee 57,5&nbsp;% rodi\u010d\u016f fyzick\u00fd trest n\u011bkdy pou\u017eilo a&nbsp;velk\u00e1 \u010d\u00e1st z&nbsp;nich jej bere jako sou\u010d\u00e1st v\u00fdchovy. V\u00edce ne\u017e 60&nbsp;% rodi\u010d\u016f, kte\u0159\u00ed dnes fyzick\u00e9 tresty pou\u017e\u00edvaj\u00ed, bylo jako d\u011bti rovn\u011b\u017e takto trest\u00e1no. \u201eKa\u017ed\u00fd z&nbsp;n\u00e1s si v&nbsp;d\u011btstv\u00ed tvo\u0159\u00ed p\u0159edstavu o&nbsp;sv\u011bt\u011b \u2013 o&nbsp;d\u011btech, rodi\u010d\u00edch, rodinn\u00e9m fungov\u00e1n\u00ed v\u010detn\u011b toho, co je v&nbsp;rodin\u011b norm\u00e1ln\u00ed. Pokud d\u00edt\u011b vyr\u016fst\u00e1 v&nbsp;rodin\u011b, kde jsou fyzick\u00e9 tresty na denn\u00edm po\u0159\u00e1dku, kde prob\u00edh\u00e1 n\u00e1sil\u00ed i&nbsp;mezi jeho rodi\u010di, zvnit\u0159\u0148uje si tuto normu a&nbsp;nejsp\u00ed\u0161e bude m\u00edt tendenci tyto nebo podobn\u00e9 vzorce opakovat i&nbsp;ve sv\u00e9m pozd\u011bj\u0161\u00edm partnersk\u00e9m vztahu nebo sm\u011brem k&nbsp;vlastn\u00edm d\u011btem. Pokud tyto vzorce nebude spole\u010dnost korigovat, budou se p\u0159en\u00e1\u0161et d\u00e1le,\u201c \u0159\u00edk\u00e1 psycholog V\u00e1clav Chytr\u00fd. Samoz\u0159ejm\u011b existuj\u00ed i&nbsp;v\u00fdjimky, kdy d\u011bti naopak v&nbsp;d\u011btstv\u00ed z\u00edskaj\u00ed d\u00edky sv\u00fdm zku\u0161enostem k&nbsp;t\u011blesn\u00fdm trest\u016fm siln\u00fd odpor a&nbsp;sna\u017e\u00ed se v&nbsp;dosp\u011blosti neopakovat to, co samy za\u017e\u00edvaly.<\/p>\r\n<p><strong>Ztr\u00e1ta bezpe\u010d\u00ed<\/strong><br \/>\r\nV\u011bt\u0161ina spole\u010dnosti z\u0159eteln\u011b vn\u00edm\u00e1 rozd\u00edl mezi \u201ejedn\u00edm pl\u00e1cnut\u00edm\u201c a&nbsp;opakovan\u00fdm n\u00e1sil\u00edm. Av\u0161ak ve vn\u00edm\u00e1n\u00ed rozd\u00edlu mezi \u201epl\u00e1cnut\u00edm\u201c z&nbsp;pohledu dosp\u011bl\u00e9ho a&nbsp;z&nbsp;pohledu d\u00edt\u011bte u\u017e tak jasno nen\u00ed. \u201eDosp\u011bl\u00fd \u010dasto vn\u00edm\u00e1 pl\u00e1cnut\u00ed jako ,mal\u00e9 napomenut\u00ed\u2018 bez v\u011bt\u0161\u00edho v\u00fdznamu. Pro d\u00edt\u011b ale m\u016f\u017ee j\u00edt o&nbsp;siln\u00fd z\u00e1\u017eitek ohro\u017een\u00ed, pon\u00ed\u017een\u00ed nebo ztr\u00e1ty bezpe\u010d\u00ed. Roli v&nbsp;tomto p\u0159\u00edpad\u011b hraje emo\u010dn\u00ed pam\u011b\u0165, kter\u00e1 si ukl\u00e1d\u00e1 z\u00e1\u017eitky na \u00farovni pocit\u016f, ne slov. V&nbsp;terapii se s&nbsp;t\u011bmito emocemi \u010dasto setk\u00e1v\u00e1me \u2013 i&nbsp;po des\u00edtk\u00e1ch let.
